As a certified NY State Sampling Agent, the most important aspect of this process is to help you, the grower, succeed in obtaining the proper results for your plants. Operating in a “time is of the essence” manner is part of my key focus. 

What I will guide you through…

New York State’s Hemp Program is providing growers with a road to diversify crops and tap into all new up and coming markets, and as a certified agent my mission is to help ensure that success for you.

  1. Samples will be taken to obtain specimens for the measurement of total tetrahydrocannabinol (THC) content, which determine whether the specimens are hemp or marijuana. The measurements are intended to be representative of the total THC content in a “lot” of hemp crop acreage as identified by the producer.

  2. Within 30 days prior to the anticipated harvest of a designated hemp lot, as an approved sampling agent, I will collect representative samples from such cannabis plants for THC concentration level testing. A sampling protocol must have the potential to ensure, at a confidence level of 95 percent, that the cannabis plants will not test above the acceptable hemp THC level of 0.3 percent on a dry weight basis.

Growers Responsibilities

  • Growers must communicate any special laboratory procedures or shipping requirements to the Sampling Agent.

  • Growers must submit a Pre-Harvest Report at least 30 days before the anticipated harvest date of each hemp lot.

  • Growers must hire a Sampling Agent such as myself, and identified THC testing facilities from the published lists on the Department’s website (see below).

  • Growers are responsible for all costs of sampling, shipping, and testing of hemp samples.

  • Growers must have approval from the Department to harvest.

  • Hemp must be harvested within 30 days of the regulatory sampling date.


***All lots may be subject to state-mandated sampling. Sampling will be decided at the discretion of the Department. The Department will notify growers if they have been chosen for sampling. The Department will notify the selected Sampling Agents of the samples required. As a Sampling Agent, I will collect the regulatory samples and send them to the growers’ preferred testing facilities.
